Conditions of carriage
The conditions under which SAVA LOGISTIC accepts and performs road freight services. They apply to every loading order accepted, unless otherwise agreed in writing.

Acceptance
By confirming receipt of the loading order and proceeding with the service, these conditions are deemed accepted.
These conditions are not punitive in nature.
Legal framework
We accept the loading order under the CMR Convention and Spanish Law 15/2009 of 11 November on the inland carriage of goods contract (BOE-A-2009-18004).
Proof of delivery
The proof of delivery may be the CMR, the consignment note or the packing list, in original or digital format.
Obligations at the loading and unloading points
- The loading and unloading points assume responsibility for the operations, which are carried out under the driver's supervision. Where the driver is not allowed to supervise them, we are not liable for any damage alleged.
- At the time of loading, the final destination of the goods must be stated together with the loading references, never SAVA.
- The goods must always be accompanied by a packing list in which the quantities and the weight loaded match.
- The arrival time, the departure time and the loading metres and weight loaded must be recorded on the consignment note or CMR.
- Any discrepancy in the loading metres must be reported immediately by email and by telephone. The vehicle may not leave the loading place without prior authorisation.
- Where these facts are not recorded at the time of loading, we cannot accept subsequent changes to the price.
Transhipment and handling
Under any loading regime there is the possibility of transhipment, handling and stacking of the goods, provided the goods themselves allow it and it poses no danger to the integrity of their contents.
Warehouse in Spain and opening hours
For carriage from or to our warehouse in Spain, at Carrer de l'Empordà 1-7, 08211 Castellar del Vallès (Barcelona), the opening hours are 09:00 to 18:00.
The unloading reference must be recorded on the documents.
Vehicle waiting time
- Groupage regime: waiting time is counted from the first half hour.
- Full truck regime: waiting time is counted from the first hour.
- It is calculated by applying the IPREM in accordance with the applicable regulation.
- Where the vehicle arrives at least one hour before the point closes and is still not loaded or unloaded, the driver's remaining drivable time for that day and the waiting hours of the following day until the operation is carried out are counted as waiting time.
Loading metres, weight and volume
Where the loading metres loaded exceed those contracted, or where the weight or volume does, the price is updated to the proportional part of what was initially contracted.
Where the loading metres are not specified in the contract, those stated in the offer apply.
Cancellations
- Day before loading: any derived expenses, if there are any.
- Same day as loading: the full transport price.
Payment
The maximum payment term is 30 days, counted from delivery of the invoice and the proof of delivery by digital means.
Jurisdiction and dispute resolution
We expressly state, before the start of each carriage and for the purposes of Article 38 of the Spanish Land Transport Act (LOTT), our intention not to submit to the Transport Arbitration Boards (Juntas Arbitrales del Transporte).
The parties submit to the Courts and Tribunals of the city of Barcelona.
In international carriage subject to the CMR Convention, the foregoing is without prejudice to the jurisdictions that its Article 31 recognises as mandatory.
